Apply 2 Save Owner Permanently Barred from Idaho Loan Businesses
The owner of Apply 2 Save, a bankrupt Coeur d’Alene, Idaho, mortgage
modification company, that allegedly defrauded hundreds of consumers
nationwide is prohibited from ever operating a similar business in
Idaho, Attorney General Lawrence Wasden said. Derek Oberholtzer entered
a settlement agreement with Wasden’s office that prevents Oberholtzer
from acting as a debt or credit counselor and prohibits him from
engaging in mortgage lending, brokering, or modification activities
within Idaho or with Idaho consumers.

Boise Car Dealer and Ohio Marketing Company Settle Rebate Lawsuit
Fifty-seven consumers who bought cars from Dennis Dillon Auto
Park in 2004 and 2005 will receive restitution as a result of a
settlement agreement between the state of Idaho, the Boise dealership
and Gunning & Associates Marketing, Attorney General Lawrence Wasden
said. The settlement resolves the Attorney General’s consumer protection
lawsuit against the two parties for promoting a “Cash Rewards” program.

Three Barred from Mortgage Modification Business
The owners of a North Idaho mortgage modification company
are prohibited from engaging in loan modification activities with Idaho
consumers, Attorney General Lawrence Wasden said today. Randy Allen,
Clint Paulsen, and Travis Smith, who operated HomeModifier in Post
Falls, signed a consent judgment that prevents them from opening a new
mortgage modification business in Idaho.

Attorney General’s Consumer Protection Staff to Visit Orofino
Consumer specialists from Attorney General Lawrence Wasden’s office will be in Orofino to talk about current scams and
strategies for avoiding fraud. Wasden encourages the public to attend
the session at the Clearwater Memorial Public Library in Orofino from
10:00 – 11:00 a.m. on Tuesday, August 24.

Coeur d’Alene Home Care Provider Jailed for Overbilling Medicaid
Barbara Buvel, 53, of Coeur d’Alene was sentenced yesterday
to 80 hours of labor inmate detail for defrauding the Idaho Medicaid
Program. First District Judge Barry Watson also sentenced Buvel to two
years of supervised probation and ordered her to pay back the Idaho
Medicaid Program $3,015. The court ordered and suspended a 315 day jail
sentence. Buvel pleaded guilty on July 1, to one misdemeanor count of
Petit Theft.

Idaho to Collect $1.9 Million in Drug Pricing
Settlement
Four prescription drug manufacturers will pay Idaho $1.9 million in a
legal settlement resolving Idaho’s claims relating to their reporting of
“average wholesale price,” Attorney General Lawrence Wasden said.

Herrin Sentenced for Medicaid Fraud
Idaho Falls resident Sandra L. Herrin was sentenced to prison for
Medicaid provider fraud, Attorney General Lawrence Wasden said. Seventh
District Judge Joel Tingey ordered Herrin to serve up to three years in
prison. The Court suspended the prison sentence and ordered her to serve
30 days in jail.

Personal Care Provider Sentenced for Medicaid Fraud
Bonners Ferry resident Coral Mouser was sentenced for Medicaid provider
fraud, a felony, Attorney General Lawrence Wasden said. First District
Judge Benjamin Simpson sentenced Mouser to five years in prison, a
$5,000 fine and ordered her to pay restitution. The Court suspended the
sentence and ordered Mouser to serve 45 days in jail and to pay $12,465
in restitution to the Idaho Department of Health and Welfare.

Attorney General Recovers More Than $100,000 in Medicaid Fraud Settlement
The State of Idaho has received $106,648.90 from a legal
settlement with pharmaceutical manufacturer, Alpharma Inc., Attorney
General Lawrence Wasden said.
